Esto es la Universidad.... pública




Este blog está dirigido a vosotros, los estudiantes que acabáis de llegar a la Universidad. A la Universidad pública. A la universidad de todos. La que costeamos entre todos para que independientemente del nivel de vuestros ingresos familiares tengáis la oportunidad de aprender y de transformar vuestra vida. Para que aprendáis Derecho y, sobre todo, os convirtáis en personas pensantes y críticas, dispuestas a integraros inteligentemente en el mundo que os ha tocado vivir.

En este blog encontraréis primero las instrucciones para sacar el máximo provecho de "nuestro" esfuerzo conjunto a lo largo de estas semanas de clase. Pero también algo más: una incitación permanente a aprender, un estímulo para que vayáis más allá de la mera superación del trámite administrativo del aprobado. Escribía el piloto, escritor y filósofo francés Antoine de Saint Exupéry (1900-1944) en El Principito, que "sólo se conocen las cosas que se domestican". Por eso voy a tratar de convenceros de lo importante que es "domesticar" lo que vais a estudiar. Para que sintáis lo apasionante que es descubrir el mundo a través del Derecho. Pero no del Derecho a secas, sino del Derecho en su trayectoria histórica, en el marco cultural de la civilización en la que aparece. Para que comprendáis como sugería José Ortega y Gasset, que preservar nuestra civilización depende de que cada generación se adueñe de su época y sepa vivir "a la altura de los tiempos".

Para ello cada semana os diré qué tenéis que estudiar y cómo, os proporcionaré lecturas y os recomendaré ejercicios. También compartiré con vosotros pensamientos y consideraciones que vengan a cuento, al hilo de lo que vayamos estudiando.

Tendremos que trabajar mucho, vosotros y un servidor. Pero eso dará sentido a vuestro -nuestro- paso por la Universidad. Será un esfuerzo muy rentable para vuestro -mi- engrandecimiento como personas. Os lo aseguro.

Comments on Moot Test of March 26, 2020

I hope this entry finds you in good health and that this bloody Covid 19 has not affected your family or relatives. 

First of all I want to thank again those of you who have participated in the test. Specially those who have complied with the rules, have been on time, and have been honest not looking into your notes or in Wikipedia. It is relatively easy to see who has done a personal effort, and has tried to answer with her/his memory and her/his own words. Those are learning. The ones who have cheated have done a useless exercise. I am not here to judge, everyone will deal with his own conscience. But I have a pretty precise idea about who has been serious and who has not. And I will take this into consideration for the final “mark” that you will be receiving after the final written presential exam. I am very sorry but this Covid 19 stuff will not enable me to have you pass an oral test, as I would have preferred. 

But thanks to your Book Reports, and the responses of your Moot Test I think honestly I have a pretty precise image of your work. Of course limited to those of you who have responded in this unusual circumstances. 

By the way so far most of you have not realized how important is to have read well and work the three books of Jonathan Coe Middle England, Robert Menasse The Capital and Michel Houellebeq Submission you are entitled to read. A substantial part of your note will depend on how seriously you have performed your reading assignments. So if you have not done it, I will strongly recommend you do a “personal” commentary and analysis. If you copy your work it will be useless and I will not take it into account for your final mark. All this time of confinement is a great opportunity for getting used to READ... Your intellectual development will improve considerably.   

I will be sending  by email to everyone of you their personal results. But I want to give an overall view of the exams.  

OVERALL COMMENTS ON HOW YOU DID PERFORM: 

1. I know you did not have all of you the technical tools to scan and resend your exam. But honestly it has been a torture when you have sent me your copy in different parts with no order. That has delayed the correction of the tests a lot. And by the way had given me a poor impression on your organization. It is not very difficult to order the pages and send them by order. Specially considering you had 2 and a half hours, which is a lot of time for the type of test. Fortunately most of you have done a great job. Thanks for it.

2. I have marked very well students that have done an honest effort. You can see the people who do not know all the dates. And it is suspicious when people give all the correct dates with years, months and dates. Nevertheless some of you can have a great memory. But this is exceptional.

3. Many of you repeat some formulas for answering the questions. Either you have learned the answers by heart copying from Wikipedia, either you have copied from your notes and materials. This is a clue that you have not done a good or honest job. Of course I do not want to generalize. But I appreciate much more the answers when you use your own words, especially when you have a clear mind. Something that is easy to discover. This persons have the better notes.

4. A lot of you have not taken profit of the Middle England question. And it is a pity because your final mark could have been much better. Some of you have done a quite decent commentary, but unfortunately they are an exception. 

5. For when you will receive your notes with the remarks on how you have done in each part of the exam I want you to know the meaning of the signs you will find in the email; 

Bien: means your answer is complete, original and well thought. Then you get the full points. 

b.bien: means a decent job but with some “gaps” or omissions. You get 75% of the points. 

Reg: means you have some clue, but your answer is not great. You get 50% of the points.

Muy flojo: means you have a vague idea, but rather insufficient. You get 25%.

6. How do I get to the final mark? Every part counts for 10 points. I add the results in every part and the divide by 4. With the Middle England question you could add up to an extra 1 point more to the result of the average of the four parts. 

7. For those who have not presented the test on time, that is before 19:30 March 26, 2020 (14 out of 54) I have reduced the score of the final mark, according to the delay on sending  the exam.


OVERALL COMMENT ON THE GRADES

The top grade is 9,6 and the lowest 2,4. 

Only 7, out of 54 have failed. And from these only two with very low grades. 

Between 5 and 6: 13

Between 6 and 7: 16

Between 7 and 8: 8

Between 8 and 9: 8

Over 9: 2

FINAL REMARK: 

I have completed the exam WITHOUT LOOKING AT THE MATERIALS. With my own words, and according to what I would have done if I was a student. You can compare your exam with it and then when you will get your mark individually try to understand.

 I will not answer any further email concerning the Moot exam. I will be free to share it with you when we can meet again presentially. I hate on line teaching, as I believe that personal contact is by far more enrriching. On the other hand considering the high number you are it is impossible to give you a decent treatment through the "machine". Doing this test it has been exhausting. But I felt I owed you that. 

I will only answer urgent emails with peremptory questions, or details about the new Teaching Guides. By the way I will be sending this week the instructions for studying Teaching Guide number 11. 

The corrected exam will follow in a separate entry. I will be also sending you individual emails with your results and comments in the following days.
